Terms of Use
1. Introduction
Welcome to Outdoorplotpro. These Terms and Conditions govern your access to www.outdoorplotpro.com and your purchase of personalised garden layout improvement and outdoor space planning services.
By submitting an order, you confirm that you have had the opportunity to review these Terms and the relevant service description. Your order remains subject to acceptance and confirmation in accordance with the process set out below.
These Terms apply alongside any quotation, order confirmation and service-specific arrangements agreed with you. Where mandatory consumer protection legislation applies, these Terms do not restrict your statutory rights.
2. Our Services
Outdoorplotpro provides personalised services relating to garden layouts and the arrangement of outdoor spaces. Depending on the service selected, the work may include an initial assessment, recommendations for garden areas, pathway and seating arrangements, planting zones, space organisation and an agreed improvement plan.
The exact scope of each service depends on the relevant product description and the quotation accepted by the customer.
Physical alterations, construction work, planting supplies, materials, waste removal, additional visits and other supplementary tasks are included only where expressly specified in the accepted quotation.
Photographs and examples displayed on our website are provided to illustrate the general nature of our services. The final scope and deliverables are determined by the written arrangements agreed for each order.
3. Enquiries and Quotations
Customers may submit an enquiry through our website or contact us directly.
Before issuing a quotation, we may request information about the property, the available outdoor space, the requested improvements, the service address and any relevant access arrangements.
A quotation will identify the agreed work, applicable charges and other relevant arrangements. Quotations are subject to the validity period stated in the quotation itself.
An enquiry or request for a quotation does not, by itself, constitute an accepted order. Work will be scheduled after the order has been accepted, the required deposit has been received and any necessary arrangements have been agreed.
4. Website Prices and Deposits
Prices displayed on our website represent deposits towards the selected services, not the full service fee, unless expressly stated otherwise.
Before an order is confirmed, the customer will be informed of the total agreed service fee, the deposit payable, the outstanding balance and any applicable additional charges.
The deposit will be credited towards the total service fee. The remaining balance is payable in accordance with the accepted quotation and the payment arrangements confirmed for the order.
Customers should review the complete quotation and payment details before submitting an order. Payment of the deposit does not authorise work outside the agreed scope.
Where an additional task or change is requested, the relevant charge and any effect on the schedule must be agreed before that additional work proceeds.
5. Order Acceptance and Confirmation
An order is subject to confirmation by Outdoorplotpro. We may contact the customer to clarify the requested services, confirm the quotation or obtain information reasonably required to arrange the work.
The customer should check the order confirmation and promptly notify us of any material error in the service description, contact details or agreed charges.
Where we cannot accept an order, any payment received for that unaccepted order will be handled in accordance with applicable law.
The accepted quotation, order confirmation and these Terms should be read together when determining the agreed scope and payment arrangements.
6. Customer Responsibilities
Customers are responsible for providing accurate information about the property, the requested work and any relevant site conditions.
Before an agreed visit, customers must arrange reasonable access to the relevant areas and inform us of any known restrictions, access requirements or circumstances that may affect the work.
Where permission from a property owner, landlord, management body or other authorised person is required, the customer must obtain that permission before the relevant work begins.
Customers should also identify any underground installations, restricted areas, existing structures or other site conditions that may materially affect the agreed work.
Delays or additional work arising from inaccurate information, unavailable access or undisclosed site conditions may require a revised quotation and schedule, subject to the customer’s agreement and applicable law.
7. Changes to an Order
Customers may request changes to the agreed scope before or during the service.
A requested change may affect the total fee, materials required, appointment arrangements or completion date. Any material change must be discussed and agreed by both parties before the additional work proceeds.
If a requested change cannot reasonably be accommodated, we may continue with the original agreed scope where appropriate or discuss other available arrangements with the customer.
No additional charge will be imposed for unapproved work, except where a different treatment is expressly permitted by applicable law.
8. Appointments and Scheduling
Appointment arrangements are agreed individually according to the service location, the work required, access arrangements and the availability of relevant personnel.
Customers should provide reasonable notice when requesting an appointment change. Where an appointment cannot proceed because access is unavailable or relevant information has not been provided, the parties may need to agree a revised appointment.
Weather conditions, site restrictions, material availability and circumstances beyond reasonable control may affect the expected schedule. Where a significant change arises, we will communicate the relevant information and discuss an appropriate revised arrangement.
Any rescheduling charge must be disclosed in advance and applied in accordance with the agreed terms and applicable law.
9. Cancellations and Withdrawal Rights
Cancellation requests should be submitted in writing to shift@outdoorplotpro.com, with the order reference and relevant details.
For consumers in the European Union, a statutory right of withdrawal may apply to contracts concluded online or away from business premises. Where applicable, the withdrawal period is generally 14 days, subject to the relevant statutory rules and exceptions.
If a customer requests that a service begin during the withdrawal period, any legally required express request and acknowledgement will be obtained. Where a consumer withdraws after requesting an early start, an amount for services already performed may be payable only where the applicable legal conditions are satisfied.
The right of withdrawal may be lost for certain services once they have been fully performed, but only where the applicable statutory conditions, including any required express consent and acknowledgement, have been met.
For customers in Mexico and other European countries, cancellation and withdrawal rights will be assessed under the applicable consumer protection legislation.
Nothing in these Terms removes a statutory right to cancel or withdraw where that right applies.
10. Deposits, Refunds and Outstanding Balances
The treatment of a deposit depends on the order status, the agreed service arrangements, any work already performed and the applicable legal requirements.
A deposit is not automatically non-refundable in every circumstance. Where a cancellation, withdrawal, service failure or other event gives rise to a refund entitlement under applicable law or the agreed terms, the relevant amount will be assessed accordingly.
Where a customer cancels after work has commenced, any amount retained or payable for work already performed must be supported by the applicable contractual terms and legal requirements.
If a refund is due, it will be processed using the applicable payment method or another method agreed with the customer where permitted by law. The processing period will follow the relevant statutory requirements and applicable transaction procedures.
The outstanding balance is payable in accordance with the accepted quotation. If a payment is overdue, we may contact the customer to request settlement and may exercise any remedies available under the agreed terms and applicable law.
11. Performance and Completion
The service will be carried out according to the scope and deliverables specified in the accepted quotation.
Completion is assessed against the agreed service description rather than an expectation of results not included in the quotation.
If the customer believes that an agreed task has not been completed or that a deliverable differs materially from the accepted scope, the customer should contact us with the order reference and a description of the issue so that it can be reviewed.
Any applicable statutory rights relating to non-performance, defective services or remedies remain unaffected by these Terms.
12. Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Subject to that restriction, Outdoorplotpro is responsible for losses that are legally attributable to a breach of its contractual obligations, in accordance with the applicable legal rules.
We are not responsible for delays or additional costs caused by inaccurate information supplied by the customer, unavailable property access, unauthorised alterations by others or circumstances beyond our reasonable control, to the extent permitted by law.
Customers remain responsible for obtaining any property permissions required for the agreed work and for providing accurate information about relevant site conditions.
Nothing in this section excludes liability for fraud, wilful misconduct or any other liability that cannot lawfully be excluded or limited.
13. Circumstances Beyond Reasonable Control
Where circumstances beyond a party’s reasonable control materially affect the agreed service, the affected party should notify the other party as soon as reasonably practicable.
The parties will discuss reasonable adjustments to the schedule or service arrangements. Any cancellation, refund or other remedy will be determined in accordance with the agreed terms and applicable law.
This section does not remove consumer rights or payment obligations that continue to apply under mandatory legislation.
14. Complaints and Dispute Resolution
Customers wishing to raise a concern should contact shift@outdoorplotpro.com and provide the order reference, a description of the issue and any relevant supporting information.
We will review the enquiry and respond within a reasonable period. Where appropriate, we may request further information to clarify the circumstances.
Nothing in this section prevents a customer from contacting a competent consumer protection authority, using an available statutory complaint procedure or bringing a claim before a court with appropriate jurisdiction.
15. Privacy and Personal Information
Personal information provided in connection with enquiries and orders is handled in accordance with our Privacy Policy and applicable data protection legislation.
Customers should consult the Privacy Policy for information about the purposes of processing, data retention, disclosures, international transfers and applicable data protection rights.
16. Amendments to These Terms
We may revise these Terms when necessary to reflect changes in our services, order procedures or applicable legal requirements.
The version applicable to an order will be identified through the relevant order confirmation or other appropriate record. Changes will not retrospectively remove contractual rights already acquired by a customer.
Where applicable law requires specific notice or consent for a change, the relevant requirements will be followed.
17. Governing Law and Jurisdiction
These Terms are governed by the applicable laws relevant to the transaction, subject to mandatory consumer protection rules.
Where a consumer habitually resides in an EU Member State and the relevant legal conditions are met, a choice of law must not deprive that consumer of the protection afforded by mandatory provisions of the law that would otherwise apply under the relevant conflict-of-law rules.
Nothing in these Terms prevents a consumer from bringing proceedings before a court where that consumer is entitled to do so under applicable law.
For customers in Mexico, applicable Mexican consumer protection legislation and the jurisdiction of competent authorities and courts remain unaffected.
